1. The service
mistKET lets businesses accept cryptocurrency payments. You create invoices through our API or merchant panel, your customers pay on our hosted checkout page, we detect the payment on the blockchain, notify your server with a signed webhook and credit the payment to your merchant balance. You can then request a payout to your own wallet.
Customer payments are sent to deposit addresses operated by mistKET. Confirmed payments are recorded in an internal ledger as your balance per asset. We are a technical payment service; we are not a bank, an exchange or an investment service, and balances do not earn interest.
The assets and networks available on the checkout are shown on our website and in the panel. We may add, suspend or remove assets and networks, for example for security, liquidity or network reasons.
2. Eligibility
To use mistKET you must:
- be at least 18 years old and able to enter into a binding agreement, or act on behalf of a business you are authorised to represent;
- not be located in, or organised under the laws of, a country or territory subject to comprehensive sanctions, and not be listed on, or owned or controlled by a person listed on, any applicable sanctions list;
- provide accurate, complete and current information and keep it up to date.
You are responsible for complying with all laws that apply to your business, including any licence or registration your activity or your customers' jurisdiction may require.
3. Accounts and project approval
You sign up with an e-mail address and password. Each website or Telegram bot you want to accept payments on is a separate "project" with its own API keys, webhook and balance. Every project is reviewed by our team before it can accept payments; API keys can only be created for approved projects.
We decide on approval at our discretion and may reject an application, ask for additional information or documents about you, your business, your products or the source of funds (KYC/KYB) at any time, and suspend a project until that information is provided.
You are responsible for all activity under your account. Keep your password, recovery code and API secrets confidential and tell us immediately if you suspect unauthorised access.
4. Prohibited businesses and activities
You may not use mistKET for, or in connection with:
- anything illegal in your jurisdiction or in the jurisdiction of your customers;
- narcotics, controlled substances, weapons, ammunition or explosives;
- child sexual abuse material, non-consensual content or any content involving minors in a sexual context;
- fraud, scams, phishing, fake shops, pyramid or Ponzi schemes and "high-yield" investment programmes;
- money laundering, terrorist financing, sanctions evasion or mixing/tumbling services;
- stolen data, accounts or payment credentials, malware, hacking or DDoS services;
- counterfeit goods or goods infringing intellectual property rights;
- gambling, securities, investment or other regulated financial services without the required licence.
We may update this list. If we have reason to believe a project breaches this section, we may reject or suspend it, hold the related funds while we review the case and report it to the competent authorities where the law requires.
5. Anti-money-laundering and sanctions
We may screen accounts, projects, transactions and wallet addresses against sanctions lists and risk indicators. We may delay or refuse a payment credit or payout, ask for information about a transaction, or freeze funds connected with suspected illegal activity, to the extent permitted or required by law.
6. Fees
We charge a commission on each confirmed payment, calculated as a percentage of the amount received for the invoice and deducted when the payment is credited to your balance. Rates start from 0.5%; the standard rate is 2.49%. Lower rates may be agreed for higher volumes. The rate that applies to a project is set when the project is approved and is shown in your panel settings.
There is no setup fee and no monthly fee. Expired, cancelled or unpaid invoices are free. We currently do not charge a payout fee; if we introduce a payout or network fee, it will be shown to you before you request a payout.
We may change our fees by notifying you at least 14 days in advance through the panel or by e-mail. Changes do not apply to payments confirmed before they take effect.
7. Payments, rates and confirmations
When an invoice is priced in a fiat currency, the crypto amount is calculated at the exchange rate locked when the payment amount is set (when the invoice is created with an asset, or when the customer selects the asset and network on the checkout) and stays valid for the invoice lifetime. A payment is confirmed once the network reaches the number of confirmations we require; only confirmed payments are credited.
Cryptocurrency transactions are irreversible. There are no chargebacks. Refunds to your customers are your responsibility and are arranged between you and your customer.
8. Underpayments, overpayments and late payments
- Underpayment: each project has an underpayment tolerance (1% unless agreed otherwise). A payment within the tolerance completes the invoice. A larger shortfall marks the invoice as underpaid; while it is open, the customer can pay the remaining amount and partial payments add up.
- Overpayment: a payment that exceeds the invoice amount by more than 1% is marked as overpaid and reported in the webhook. The full amount received is credited to your balance (less the commission). Whether to refund the excess is your decision.
- Late payments: after an invoice expires, its deposit address is still monitored for a short window (currently 10 minutes) and payments received in that window are credited to that invoice.
- Transfers received after that window, on the wrong network, in an unsupported asset or that cannot be matched to an invoice are not credited automatically. We will review them in good faith, but recovery is not guaranteed and may be impossible.
9. Balance and payouts
You can request a payout of your available balance in an asset to a wallet address you provide. The amount is reserved immediately, sent after review and recorded with its transaction hash. You are responsible for entering the correct address and network; transfers sent to a wrong address cannot be reversed.
We may delay a payout for security or compliance reviews and may refuse it where these Terms or the law require.
10. API keys and webhooks
Keep your API key secret and webhook secret confidential, store them only on your server and rotate or revoke them in the panel if they may have been exposed. Requests made with your keys are treated as made by you. We recommend enabling the IP allow-list and verifying the signature of every webhook before fulfilling an order.
11. Integration support
On request, our team can help you integrate mistKET or set up the integration for you. We do this as a courtesy and free of charge. You remain responsible for your website, bot and order fulfilment, and you should test the integration before going live. Never share your panel password with us; we will never ask for it.
12. Suspension and termination
You may stop using mistKET and ask us to close your account at any time through support. We may suspend or terminate your account or a project if you breach these Terms, if required by law, or if your activity creates a security, legal or reputational risk. Unless the law or an ongoing review prevents it, we will pay out your remaining available balance to an address you provide.
13. Disclaimer and limitation of liability
The service is provided "as is" and "as available". We do not guarantee uninterrupted operation and are not responsible for delays or failures of blockchain networks, forks, wallets, explorers, exchange-rate sources or other third-party services, or for errors in the information you or your customers provide.
To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the commissions you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
You will indemnify us against claims arising from your products or services, your dealings with your customers or your breach of these Terms or of the law.
14. Taxes
You are responsible for determining and paying any taxes that apply to your sales and to payments you receive through mistKET.
15. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. We will notify you of material changes through the panel or by e-mail before they take effect; if you continue to use the service afterwards, you accept the updated Terms.
16. Contact and disputes
Contact us on Telegram at @mistnetwork or by opening a support ticket in the merchant panel. We will first try to resolve any dispute through our support channels. If it cannot be resolved, it will be decided by the competent courts at the operator's place of business, unless mandatory law provides otherwise.
